Commonwealth v. E.F.
Police conducting a car stop for invalid registration stickers alleged that as they were approaching they observed E.F., the front seat passenger, make a “dipping motion” under the seat. E.F. and the driver were taken out of the car and police conducted a search. During the search they found a loaded firearm under the front seat. At trial the defense challenged officer credibility and argued that E.F. did not possess the firearm that was recovered making this not the defendant’s firearm offense in Philly.
