Commonwealth v. C.C.
A large fight that erupted outside of a house party tragically left one individual in a coma after he was kicked in the head, punched, and kicked multiple times. The victim lost eight teeth, had his jaw wired shut, and still has a metal plate in his face. C.C. was one of two individuals arrested for the incident on the basis of assault in Philadelphia after the victim and his brother identified him to police. However, defense investigation revealed that the witnesses had provided different descriptions of the assailants shortly after the incident as well as a conflicting version of events. These inconsistencies were exposed during cross examination at trial, and the defense also presented an independent eyewitness who contradicted the Commonwealth’s questionable evidence.
