In the majority of criminal cases, when bail is set, anyone can post ten percent of the total amount without having to explain where the money came from. If that amount is posted the person will be allowed to “fight the case from the street.” However, in certain cases, usually where there are large amounts of cash and/or drugs involved, a Nebbia Order will be attached to the bail. In those situations, the person who wishes to pay the bail has to convince a judge that the money being posted came from a “legitimate source” rather than from the proceeds of drug sales or other illegal activities. If the surety (the person posting bail) can establish that the bail money is legitimate through bank account records, real estate holdings or other documentation then the judge will lift the Nebbia and allow bail to be posted.
