Commonwealth v. C.F.

Police officers observed C.F. run a red light, and after a high speed chase C.F. crashed the car he was driving into another motorist. He then fled and was apprehended several blocks away. After his arrest he was found to be in possession of heroin and crack cocaine. Police searched the car he was driving and found a loaded firearm in the glove box. At trial, the defense argued that there was insufficient evidence linking C.F. to the firearm, and that C.F. was guilty of misdemeanor charges only. A judge agreed and acquitted C.F. of the felony gun charges. On parole for a homicide, C.F. would have been facing 11 to 22 years (plus a significant parole violation) in jail if he had been convicted of the gun offenses. C.F. will now likely be out of jail after serving just two more months.
