Commonwealth of PA v. N.K

N.K was arrested for robbery for an incident that involved the taking of a cell phone. According to the victim he was able to get the license plate number of the car that the defendant supposedly fled in. Police ran the tag number and put him in a photo array. The victim circled the defendant’s picture as the individual who robbed him and then identified him in court. The defense was able to show that the identification process used by the police was flawed and against protocol. The defense successfully argued that the likelihood of a misidentification was high and the defendant was found not guilty of every charge for Philadelphia robbery & burglary.
