Client was charged with possession with intent to deliver narcotics after police officers on a surveillance allegedly observed him make a sale to an individual who was stopped with drugs on him. Client was stopped several minutes later on the same block, which was in a school zone making this a “mandatory-minimum” case. R. Patrick Link challenged the police officers’ ability to make observations from where they were situated on their surveillance and argued mistaken identity.
